Emulation isnt illegal. PS3 xbox and 360 have no functional emulators as they're far to advanced pieces of hardware to emulate. So you're wrong on all accounts.

Emulation isn't illegal if you have a purchased copy of said emulated game. If you emulate and do not have the game, it is illegal.
As for the second part, give it 3-5 years(that's being generous considering the computational gains we're getting ready to see.) and we'll have emulators for both systems, even if a bit on the low side for games.
